In this issue
- Jharkhand HC (6 Oct) refused to condone a 287-day delay in a compassionate appointment appeal against BCCL, finding the claim (raised 17 years after the death) stale; Calcutta HC (12 Oct) held interest on ECL monetary compensation is not automatic.
- Coal India issued mutual-request transfers of 164 executives across seven subsidiaries on 26 October.
- DIPAM says MCL and SECL are being prepared for listing in FY27; PESB has recommended a new Director (Personnel) for WCL.

1. Judgments in the period
Subrata Banerjee v. CPIO, Eastern Coalfields Limited
Central Information Commission · decision dated 28 October 2026 · File No. CIC/ECFLT/A/2025/643914
The Commission found that no reply had been given within the statutory time to an RTI application on coal allocation to State Nominated Agencies, and held that a decision in a separate, similar appeal could not be treated as res judicata. It issued a show-cause notice to the CPIO on why the maximum penalty under Section 20(1) and (2) of the RTI Act should not be imposed, and directed point-wise information within three weeks.
What it means: A CPIO’s claim that a reply was sent needs documentary proof on record; an unsubstantiated assertion was not accepted. Judgment

2. Recent rulings worth revisiting: coal compassionate appointment delay
Rashtriya Colliery Mazdoor Sangh v. Union of India & Ors. (BCCL a respondent)
High Court of Jharkhand (M. S. Sonak, CJ and Manoj Prasad, J.) · 6 October 2026 · L.P.A. No. 712 of 2025 · 2026:JHHC:29877-DB
A compassionate appointment dispute raised in 2021 for a workman who died in 2004 was dismissed by the Single Judge. The Division Bench refused to condone the 287-day delay in the appeal, treating poverty and lack of knowledge as “mere excuses and not explanations”, and found “no error in rejecting such a stale claim, particularly in matters of compassionate appointment.”
What it means: In this case, an unexplained gap of about 17 years before raising the claim, and an unexplained delay in appealing, were enough to end a compassionate appointment dispute at the condonation stage. Judgment
Eastern Coal Fields Ltd. & Ors. v. Smt. Bahamoni Mejhan
Calcutta High Court (Madhuresh Prasad and Prasenjit Biswas, JJ.) · 12 October 2026 · A.P.O.T. No. 199 of 2025 · 2026:CHC-OS:449-DB
ECL accepted that Monthly Monetary Cash Compensation under the NCWA scheme is payable from the date of the employee’s death and contested only interest. Relying on Tomorrowland Ltd. v. HUDCO, the Division Bench held that interest “is not automatic; it is an equitable relief”, that years of unexplained inaction disentitled the petitioner, and upheld the Single Judge’s refusal of interest; ECL’s appeal was dismissed.
What it means: The principal monetary compensation remained payable, but the claimant’s own long inaction, and the absence of a cross-appeal, weighed against interest. Judgment
