Coal Sector Legal Update · Issue: 22 October 2026
Interest bars, stale claims and R&R pressure points
By Siddharth Shukla, Advocate, High Court of Madhya Pradesh, Jabalpur
Developments of 7–22 October 2026 affecting Coal India and its subsidiaries (WCL, SECL, NCL): Coal India compassionate appointment rulings, no-interest clauses in arbitration, contract-worker wages and R&R.
|
|
In this issue
• Arbitration: the Supreme Court holds that a no-interest clause worded “or otherwise” is an absolute bar on pre-award interest.
• Compassionate appointment: the Jharkhand High Court rejects a claim raised 17 years after death and refuses to condone a 287-day delay.
• Wages: revised VDA for contract workers applies from 1 October 2026; NCWA-XI has expired and JBCCI-12 is yet to be constituted.

MS Sharma Enterprises v. National Building Construction Corporation
Supreme Court · 15 October 2026 · 2026 INSC 1135
Where the contract bars interest “or otherwise”, the bar on pre-award interest is absolute. The arbitrator cannot award interest contrary to that clause.
What it means: PSUs whose general conditions of contract bar interest can rely on this ruling in Section 34 challenges and when defending contractor claims for interest. Report

Rashtriya Colliery Mazdoor Sangh v. Union of India & BCCL
Jharkhand High Court (Division Bench) · 6 October 2026 · LPA 712 of 2025
The court refused to condone a 287-day delay, treating poverty and lack of knowledge of the order as “excuses, not explanations”. A compassionate claim first raised in 2021 for a death in 2004 was held stale, following Central Coalfields v. Parden Oraon.
What it means: this strengthens limitation and laches objections to belated compassionate claims, including appeals filed by unions on behalf of dependents. Judgment

BCCL v. AT-Libra BPL JV
Supreme Court · 8 October 2026 · CA 1629/2026
The Supreme Court dismissed BCCL’s challenge, leaving in place a commercial court decree of about ₹46.2 crore, with 10.5% annual interest, for hiring heavy earth-moving machinery under a 2010 contract.
What it means: long-running disputes over equipment-hire contracts carry substantial interest exposure, so they are worth reviewing early for settlement or a stronger defence. Report

2. Recent rulings worth revisiting: Coal India compassionate appointment and land-losers
|
|
Raspelli Bhagya Kishaiya v. General Manager, WCL
Supreme Court · August 2026 · 2026 INSC 841
A dependent who was within the age limit under NCWA clause 9.3.4 at the time of death cannot be rejected because the employer’s own processing, including police verification, took time.
What it means: rejections on age grounds should be checked for how much of the delay was the employer’s and how much was the claimant’s. Report
|
|
Kusmunda land-losers v. SECL
Chhattisgarh High Court (Single Bench) · June 2026
Jobs for land-losers are governed by the state’s 2007 R&R Policy, which was in force at acquisition (2010) and has no minimum-land condition. The court quashed SECL’s rejections under the 0.54-acre threshold in CIL’s 2012 policy and ordered fresh decisions within 45 days.
What it means: the same argument, that the state policy in force at acquisition prevails, can be expected in Madhya Pradesh and Maharashtra. Report
